2. USING THE SITE

By using the Site you confirm that you are at least 18 years old (or have permission from a parent or guardian) and are capable of entering into a legally binding contract.

You agree not to:

- Resell our products without our written permission

3. ORDERS AND CONTRACT FORMATION

When you place an order, you are making an offer to buy. We accept your offer (and a contract is formed) when we send you a dispatch confirmation email. Until then, we may decline an order for any reason, including pricing errors, stock unavailability, or suspected fraud.

If we cannot fulfil your order, we will refund you in full to your original payment method.

4. PRICING AND CURRENCY

Prices are shown in your local currency based on your shipping destination:
- United Kingdom customers: pounds sterling (GBP), including UK VAT where applicable
- United States customers: US dollars (USD)
- Australian customers: Australian dollars (AUD)

All customs duties and import taxes are included in the displayed price. The amount you see at checkout is the final amount payable.

We make every effort to ensure prices are accurate. In the rare event of a pricing error, we reserve the right to cancel the order and refund you in full before dispatch.

5. PAYMENT

We accept all major credit and debit cards, Apple Pay, Google Pay, and Shop Pay. Payment is taken at the time of order. All transactions are processed securely by Shopify Payments — a PCI-DSS Level 1 certified provider. We do not see, store, or have access to your full card details at any point.

6. SHIPPING

We offer complimentary delivery worldwide. Estimated delivery times and full shipping terms are set out in our Shipping Policy.

7. RETURNS, EXCHANGES AND REFUNDS

We offer 30-day returns and direct exchanges on every order, wherever you are in the world. Full terms are set out in our Refund Policy. Your statutory rights under the consumer laws of your country of residence are not affected.

8. INTELLECTUAL PROPERTY

All content on the Site (text, images, logos, designs, photography) is owned by or licensed to Ellsworth London and is protected by UK and international copyright law. You may not reproduce or distribute any content without our written permission.

9. PRODUCT INFORMATION

We make every effort to display product colours, sizes, and details as accurately as possible. Colours may vary slightly depending on your screen. Measurements are approximate and provided as a guide.

10. LIABILITY

We do not exclude or limit our liability for:
- Death or personal injury caused by our negligence
- Fraud or fraudulent misrepresentation
- Any matter for which it would be unlawful to limit liability

Subject to the above, our maximum liability for any order is limited to the price you paid for the goods.

We are not liable for indirect or consequential losses, or for losses that were not reasonably foreseeable at the time the contract was formed.

11. EVENTS OUTSIDE OUR CONTROL

We are not liable for delays or failures caused by events outside our reasonable control (e.g. strikes, weather, supplier failures, customs delays, pandemics). If such an event affects your order, we will let you know and arrange a refund or new dispatch date as appropriate.

12. PRIVACY

Your use of the Site is also governed by our Privacy Policy.

13. CHANGES TO THESE TERMS

We may update these terms from time to time. Material changes will be communicated by email or a prominent notice on the Site. The "last updated" date shows when the terms were last revised. Continued use of the Site after changes constitutes acceptance of the updated terms.

14. GOVERNING LAW

These terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

If you live in Scotland or Northern Ireland, you may also bring proceedings in your home jurisdiction. If you live in the United States or Australia, the consumer protection laws of your country of residence apply and are not affected by this clause.
